Ho Chi Minh City Reporters: What you need to know
Before you schedule a court reporter in Ho Chi Minh City, learn more about the rules and regulations regarding U.S. depositions in Ho Chi Minh City.
Are there any restrictions on holding a U.S. depo in Ho Chi Minh City?
Vietnamese authorities do not permit foreign persons, such as American attorneys, to take depositions for use in a court in the United States. Vietnam has advised it would deem taking depositions in Ho Chi Minh City by foreign persons to be a violation of Vietnam’s judicial sovereignty. The prohibition extends to telephone or video teleconference depositions initiated from the United States to depose a witness in Hanoi.
Is there a workaround for deposing a witness based in Ho Chi Minh City?
The best solution is to have your witness travel from Ho Chi Minh City to a nearby country like Thailand or Hong Kong, and take your deposition there. Depositions are completely legal and there are no restrictions for taking them outside of Ho Chi Minh City.
Can depos in Thailand or Hong Kong take place at any venue (hotel, conference room, etc.)?
Depositions in Thailand or Hong Kong can take place at the venue of your choosing, whether that be a hotel, law firm office, conference room, or videoconferencing facility.
Does a U.S. passport holder need a visa to enter Thailand or Hong Kong?
For Hong Kong, U.S. passport holders may enter Hong Kong for up to 90 days for tourist or business purposes without a visa. For Thailand, U.S. passport holders may enter Thailand for up to 30 days for tourism. However, a business visa is required for U.S. passport holders who enter Thailand for business purposes, and there is a fee depending on the number of entries. Maximum stay for a business visa in Thailand is 90 days.
