Just days after Britain voted to leave the European Union and shocked the world, the Brexit vote continues to create havoc on global markets as the value of the pound tumbled. The Bank for International Settlements said there is likely to be a “period of uncertainty and adjustment” in the aftermath of Britain’s decision to exit. In layman’s terms, the Brexit vote has altered the European economy and its foreign policy.
Despite the uncertainty, we at Optima Juris do not expect Brexit to affect US depositions happening in the United Kingdom. With Britain’s close relations to the U.S., it remains one of the easiest places to schedule a U.S. deposition.
Any deposition restrictions?
Britain does not have any specific restrictions on where you can or can’t hold your deposition. This gives you an endless amount of options to choose from. Most depos in Britain take place in a comfortable conference room in one of the many modern and luxurious hotels or conference room facilities. Britain also has many sophisticated and reliable video-conferencing facilities available if needed. Here is the official statement from the U.S. Department of State:
“Voluntary depositions of willing witnesses in civil and commercial matters are permitted regardless of the nationality of the witness. Oral depositions or depositions on written questions may be taken by U.S. consular officers or by private attorneys at the U.S. Embassy or at another location such as a hotel or office, either on notice or pursuant to a commission. If the services of a U.S. consular officer are required to administer an oath to the witness, interpreter and stenographer, such arrangements must be made in advance with the U.S. embassy directly.”
Plan ahead!
Be sure to plan as far in advance as possible. While there are great professionals in the UK, they are in limited supply and can sometimes be booked up far into the future. The further you plan ahead, the more likely it is that you’ll be able to locate and book the right, English-based professional for your deposition.
